To play devil's advocate, they're dealing with about 40 minutes of actual story telling time. They can't afford to make everything super complex and realistic.

I think they don't intend to have him appear. which is odd because a whole phantom zone prison full of alien criminals is exactly the sort of thing he'd be dealing with already.

I get he won't actually appear. But he could be a part of the group, and his missions just aren't part of the show.
